Introduction

Talking about online gambling laws and regulations in the United States, the situation is, the least to say complex. While this activity is generally not illegal under federal law, each of the fifty states is given the complete freedom to declare whether interactive and other forms of gambling are legal or illegal in the country.

In terms of legalization, Delaware was the ice-breaking state, entering the realm of legal online casino gambling in 2012. Having passed the legislation that permitted full-service betting platforms to offer slots, poker, roulette, and blackjack, Delaware paved the way for the rapid development of the iGaming sector in the US.

Generally speaking, Delaware residents have shown a positive attitude towards legalized online gambling, as it enables them to gamble in a well-organized and regulated environment. In addition to this, the state benefits from the revenue generated through regulated gambling activities, which supports public projects and infrastructure.

On the other hand, some residents expressed concerns about problem gambling and the impact of gambling in general, especially when it comes to vulnerable groups.

Is it Legal to Gamble Online in Delaware?

The rapid development of modern technologies has inspired numerous states all over the world, especially in the United States, to embrace the evolution of online gambling and make this activity officially legal.

Justifying its status of the First State, Delaware was the pioneer in online gambling legalization.

What made the state possible to be a pioneer in such an important field was the fact that it was among four states exempted from the Professional and Amateur Sports Protection Act (PASPA), alongside Nevada, Oregon, and Montana. These four states already had permissions for sports betting included in their laws, which made it possible for them to progress in other sectors of digital entertainment as well.

With regards to the permitted categories of games, players can explore a variety of categories such as slot games, table games, and other commonly player genres. Online poker is regulated and legal as well.

Sports Betting in Delaware

Just a month after the U.S. Supreme Court struck down the PASPA, Delaware legalized in-person sports betting in June 2018.

As mentioned earlier, Delaware already had previously legalized sports betting through the passing of House Bill 100 in 2009, but it was put on hold because of PASPA. Once it fell, the state quickly implemented it.

Interestingly, mobile sports betting took much longer to gain the same status. This form of gambling was made legal in December 2023. Launched on January 3, 2024, BetRivers is the only legal and official sports betting app available in Delaware as of August 2024.

There are also three retail sportsbooks in the state, each offering an online casino powered by BetRivers, alongside retail sports betting and simulcast/ off-track betting. Those are Delaware Park Casino, Bally’s Dover Casino Resort, and Harrington Raceway and Casino. None of these three has online sports betting, though.

All accredited by Delaware Lottery, these venues have the same assortment of games, which encompasses, betting on professional and college football and basketball, pro baseball and hockey, horse racing, auto racing, international soccer, and many others. However, there’s no betting on in-state college teams.

According to the AGA’s regulatory guidelines, the legal gambling age in Delaware is 21 or older, and betting on sports has the same requirement.

An interesting thing to add is that Delaware is also one of the few states with legal and regulated daily fantasy sports (DFS). They were made legal in 2017 by Governor John Carney. Thanks to this, consumers who are 18 or older can take part in DFS contests featured on DraftKings and FanDuel.

Delaware Lottery – Games, Duties & Responsibilities

Running under the Department of Finance, Delaware Lottery has been up and running since 1975. Making the first move with “LOTTO Superfecta”, the institution gradually expanded its portfolio to include a variety of drawing games such as Powerball®, Lotto America®, Play 3®, Play 4®, Multi-Win Lotto®, Mega Millions®, Lucky for Life® and Keno, instant games, sports lottery, iGaming, video lottery, and table games.

The Delaware Lottery is responsible for regulating and overseeing various forms of legal gambling within the state, including lottery games, sports betting, and online gaming.

Aside from ensuring compliance with state laws and regulations related to gambling activities and issuing licenses, it is also in charge of managing and operating lottery games and other gambling activities, revenue allocation, and responsible gambling and player protection guidelines.

Companies interested in obtaining a gambling license from the Delaware Lottery should submit a detailed application with information about the company, its operations, and its financial status.

In addition to this, applicants need to show that they are financially stable and capable of managing operations responsibly. They also need to be prepared to adjust their policies if needed so to ensure that they are compliant with the requirements. Finally, they need to ensure that their systems and technology meet the technical standards regarding functionality and security.

Being a dedicated promoter of responsible gambling, the institution spends more than $1 million to support campaigns and fund programs to assist those experiencing the harm. The lottery tickets include an "It's The Law" message to remind consumers that they must be 18 years old to purchase tickets for games. To be able to play video lottery, sports lottery, and table games, players must be 21.

Providing assistance to the Delaware Lottery in evaluating the applicants for a license is The Division of Gaming Enforcement (DGE) in Delaware. Operating under the supervision of the Secretary of Safety and Homeland Security, this institution investigates the background, qualifications, and sustainability of each applicant seeking to acquire a license from the Delaware Lottery.
